Terms of Use & Liability
Read this before you book anything through Sarasota.Fish. It sets out what we are, what we are not, and who you are actually contracting with when you book a trip.
The short version. Sarasota.Fish is a referral service, an aggregator, and a research resource. When you book a trip, your contract is with the charter captain or boat operator — not with us. We are not a party to it, and we are not liable for what happens under it. Nothing on this site is guaranteed to be accurate, and nothing here is an endorsement of anyone. Use the site and book at your own risk.
1. What Sarasota.Fish is
Sarasota.Fish is a brand of LARGE LLC, and LARGE LLC operates the website at sarasota.fish. In these terms, “Sarasota.Fish”, “we”, and “us” mean LARGE LLC. We do three things:
- Research and publishing. We compile information about fishing in this region — species, seasons, techniques, locations, regulations, prices, and conditions — and publish it free.
- Aggregation. We collect and organise material published by other people, including public video, public data, and public agency information.
- Referral. We connect people who want to go fishing with independent charter captains and boat operators who run trips.
That is the whole of it. We are not a charter operator, a travel agency, a tour operator, a broker acting on your behalf, an insurer, or a guarantor of anyone's performance.
2. Who you contract with
Any booking, financial agreement, or contract for a charter is between you and the charter captain or boat operator. Sarasota.Fish is not a party to that agreement.
The operator sets the price, the deposit, the cancellation and weather policy, the refund terms, the departure point and time, the passenger limit, the equipment, the itinerary, and the conduct of the trip. The operator is responsible for their own vessel, licensing, insurance, crew, safety, and compliance with the law. Those obligations are theirs, and any claim arising from them lies against them.
This applies whether we introduced you to the operator, passed along your dates, relayed a message, helped arrange the booking, or collected or processed any part of a payment. Helping a transaction happen does not make us a party to it.
The single exception: if we state to you in writing, before the trip, that Sarasota.Fish is itself the operator of that specific trip, then that trip is ours and this section does not shield us from it. Absent that written statement, the operator is the captain or company you booked with.
3. How we are paid
We may receive a referral fee, commission, or similar payment when a booking is made through or as a result of this site. That fee may be paid by the operator or built into what you pay. We are telling you this plainly so that you can weigh it.
Being paid a referral fee does not make us your agent, your representative, or your fiduciary, and it does not make us responsible for the trip. It also does not mean the operators we refer to are the only good ones, the cheapest ones, or the best ones for you.
4. What “our captains” means
Across this site we use phrases like “our captains,” “the network,” and “our boats.” These are plain-language descriptions of the independent operators we work with. They do not mean those operators are our employees, agents, partners, joint venturers, or subsidiaries, and nothing on this site should be read as creating any of those relationships. Each operator is an independent business, responsible for itself.
We do not independently verify, and we do not warrant, any operator's licensing, insurance, certifications, vessel condition, safety record, or qualifications unless we expressly state otherwise in writing. You are free to ask an operator for their credentials before you book, and we would encourage it. Captains carrying passengers for hire in U.S. waters are required to hold a valid U.S. Coast Guard licence; confirming any particular captain's status is between you and that captain.
5. No guarantee of information
Everything on this site is provided for general information only, on an “as is” and “as available” basis, without warranty of any kind, express or implied.
We do not guarantee that anything here is accurate, complete, or current. Conditions on this coast change constantly and so does everything written about them:
- Regulations change. Seasons, size limits, bag limits, closures, and gear rules are set by state and federal agencies and are revised regularly, sometimes mid-season and sometimes with little notice. Always confirm current rules with the Florida Fish and Wildlife Conservation Commission before you fish or keep anything. Compliance is your responsibility and the operator's, not ours.
- Prices change. Every price, rate, and range on this site is an illustration of what trips have cost, not a quote and not an offer. Fuel, bait, insurance, demand, and season all move the number. Only the operator can quote you a price, and only the operator's quote binds anyone.
- Fishing changes. Seasonal timing, migration, bite windows, water clarity, red tide, and where fish hold vary year to year and week to week. Nothing here predicts what will happen on your trip. No catch is promised or implied — not a species, not a size, not a number, not a bite.
- Places change. Ramps, marinas, piers, businesses, hours, fees, and access all change, and storms change them fastest. Verify before you drive somewhere.
Coordinates, maps, depths, and marks published on this site are approximate and are not navigational aids. Do not navigate by them. Use current NOAA charts and your own judgement.
Nothing on this site is professional advice — not legal, safety, medical, navigational, financial, or regulatory advice. Do not treat it as a substitute for the appropriate professional or the governing agency.
6. No endorsement
We do not endorse anyone. Naming, listing, linking to, or embedding a business, captain, publication, channel, product, or service is not a recommendation, a certification, a vouching, or a warranty of that person or thing. Equally, nobody named on this site has endorsed us unless we say so explicitly.
Third-party sites we link to are not under our control. We are not responsible for their content, accuracy, availability, products, practices, or privacy handling. Visiting them is your decision. Video embedded on this site is covered separately by our embedded video policy.
7. Use at your own risk
You use this site, and act on anything you read here, entirely at your own risk.
Boating and fishing are inherently dangerous activities. They involve open water, weather, moving vessels, hooks, knives, heavy tackle, sun, marine life, and circumstances no one controls. Injury, illness, property damage, and death are possible. By using this site and by booking any trip, you accept those risks for yourself and anyone in your party. Any waiver, release, or liability form you sign is between you and the operator who asked for it.
8. No implied contract or service agreement
Nothing on this site — no page, price, description, availability, response, message, or referral — creates a contract, a service agreement, a booking, a reservation, a warranty, or any obligation on our part to you. There is no implied contract between us. A booking exists only when you and an operator make one, on the operator's terms.
9. Limitation of liability
To the maximum extent permitted by law, LARGE LLC, trading as Sarasota.Fish, and its members, managers, owners, officers, employees, and contractors, are not liable for any loss, injury, death, damage, cost, or expense of any kind — direct, indirect, incidental, consequential, special, exemplary, or punitive — arising out of or relating to:
- your use of, or inability to use, this site;
- reliance on any information published here;
- any charter, tour, trip, or service provided by any operator, including anything that happens before, during, or after it;
- any act, omission, negligence, breach, cancellation, no-show, delay, misrepresentation, or conduct of any operator or third party;
- any dispute between you and an operator, including any dispute about money;
- any third-party site, content, or service reached from here.
This applies whether the claim is framed in contract, tort, negligence, strict liability, statute, or anything else, and whether or not we were told such loss was possible.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is the case, the exclusions above apply only to the extent the law allows, and nothing here limits liability that cannot lawfully be limited.
10. Disputes with an operator
If you have a problem with a trip — the boat, the captain, the conduct, the refund, the deposit, the cancellation — that is between you and the operator, and it is theirs to resolve. Tell us anyway. We would rather know, and we can stop referring people to an operator. What we cannot do is arbitrate the dispute, compel a refund, or stand behind the obligation, because we are not a party to it.
11. Your responsibilities
- Confirm current regulations, licences, seasons, and limits before you fish.
- Confirm price, terms, deposit, cancellation, weather, and refund policy directly with your operator before you pay anything, and get it in writing.
- Tell your operator about medical conditions, mobility needs, and ages in your party.
- Follow the captain's instructions on board. On the water, the captain is in charge.
- Do not rely on this site for navigation or safety decisions.
12. Indemnity
You agree to indemnify and hold harmless LARGE LLC, trading as Sarasota.Fish, and its members, managers, owners, officers, employees, and contractors, from any claim, demand, loss, or expense, including reasonable legal fees, arising from your use of this site, your breach of these terms, or any dispute between you and an operator or other third party.
13. Content on this site
Text, photographs, video, maps, and design on this site are ours or used with permission, and are protected by copyright. Third-party material remains the property of its owner. You may read, share, and link to our pages. You may not republish substantial portions as your own. If you believe something here infringes your rights, tell us and we will look at it.
14. Changes
We may change, correct, or remove anything on this site at any time without notice, including these terms. Continued use after a change means you accept the revised version. The review date at the top tells you when this page was last looked at.
15. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute relating to this site or these terms is subject to the exclusive jurisdiction of the state and federal courts located in Sarasota County, Florida.
16. Severability
If any part of these terms is held unenforceable, that part is severed and the rest stays in force.
